Sess\u00e3o de sexta, 29\/06\/2018, foi a \u00faltima antes dos ministros do STF tirarem o recesso forense; pedido de liberdade de Lula s\u00f3 ser\u00e1 julgado em agosto – Petista pedem a liberdade de Lula em frente \u00e0 sede da Pol\u00edcia Federal em Curitiba.<\/figcaption><\/figure>\n

A ministra Carmen L\u00facia, presidente do Supremo Tribunal Federal (STF), decidiu n\u00e3o pautar o novo pedido de liberdade do ex-presidente Luiz In\u00e1cio Lula da Silva (PT) para antes do recesso do tribunal, que tem inicio nesta sexta-feira, 29\/06\/2018.<\/p>\n

O pedido de liberdade de Lula foi liberado na quinta-feira (28) para julgamento em plen\u00e1rio pelo ministro Edson Fachin, relator dos casos referentes \u00e0 opera\u00e7\u00e3o Lava Jato no tribunal. Assim, Lula passar\u00e1 ao menos mais um m\u00eas preso antes que o STF analise seu caso.<\/p>\n

A sess\u00e3o de sexta foi a \u00faltima antes dos ministros do STF tirarem o recesso forense. Eles s\u00f3 voltar\u00e3o a se reunir em plen\u00e1rio em 8 de agosto. Durante a sess\u00e3o, Carmen L\u00facia alegou que n\u00e3o pautaria o pedido de Lula por orienta\u00e7\u00e3o de Fachin.<\/p>\n

De acordo com Fachin, o pedido n\u00e3o poderia ser julgado na quinta-feira (28) a defesa de Lula (PT) apresentou um novo recurso, na forma de embargos de declara\u00e7\u00e3o, contra uma decis\u00e3o sua, o que, na avalia\u00e7\u00e3o do ministro, impede o julgamento do pedido de liberdade.<\/p>\n

Durante a sess\u00e3o, Fachin disse que os embargos precisam ser \u201cjulgados antes de qualquer ato processual\u201d, motivo pelo qual o pedido de soltura em si n\u00e3o poderia ser analisado nesta sexta-feira pelo plen\u00e1rio.<\/p>\n

\u201cQuando for o caso ser\u00e1 liberado para o plen\u00e1rio e ser\u00e1 trazido imediatamente\u201d, afirmou Carmen L\u00facia.<\/p>\n

Entenda o pedido de liberdade de Lula<\/strong><\/em><\/p>\n

Em outro recurso, sorteado para ser relatado pelo ministro Alexandre de Moraes, que questiona a decis\u00e3o de Fachin de enviar o pedido de liberdade ao plen\u00e1rio, e n\u00e3o \u00e0 Segunda Turma, como queriam os advogados, tamb\u00e9m \u00e9 pedida uma liminar (decis\u00e3o provis\u00f3ria) para que o ex-presidente seja solto.<\/p>\n

Questionado na sa\u00edda da sess\u00e3o se decidir\u00e1 ainda nesta sexta-feira sobre a reclama\u00e7\u00e3o, Moraes respondeu que sim.<\/p>\n

Nos embargos protocolados na quinta (29), a defesa quer que n\u00e3o seja julgada a quest\u00e3o da inelegibilidade de Lula, e somente sua eventual soltura, no pedido que foi enviado por Fachin ao plen\u00e1rio.<\/p>\n

Fachin disse que a quest\u00e3o deve ser tratada pela Corte por passar pela an\u00e1lise do trecho da Lei da Ficha Limpa que prev\u00ea a suspens\u00e3o da inelegibilidade \u201csempre que existir plausibilidade da pretens\u00e3o recursal\u201d.<\/p>\n

A defesa de Lula afirmou, contudo, que a an\u00e1lise da inelegibilidade n\u00e3o foi solicitada, e pede a Fachin que reverta sua justificativa.<\/p>\n

Com a confirma\u00e7\u00e3o da condena\u00e7\u00e3o na Opera\u00e7\u00e3o Lava Jato, o ex-presidente pode ser enquadrado na Lei da Ficha Limpa, que impede a candidatura de condenados pelos \u00f3rg\u00e3os colegiados da Justi\u00e7a. Caso seu o pedido de liberdade de Lula seja aceito, ele pode ser beneficiado por uma liminar e disputar as elei\u00e7\u00f5es. Ele tem at\u00e9 15 de agosto para se registrar como candidato.<\/p>\n
