Fernando Capez \u00e9 alvo principal da Opera\u00e7\u00e3o Alba Branca, que investiga desvio de recursos destinados \u00e0 merenda escolar – Em den\u00fancia, procurador-geral de Justi\u00e7a pediu a suspens\u00e3o imediata do mandato do deputado tucano e de suas fun\u00e7\u00f5es como procurador de Justi\u00e7a.<\/figcaption><\/figure>\n

O ex-presidente da Assembleia Legislativa de S\u00e3o Paulo, deputado Fernando Capez (PSDB), foi denunciado nesta segunda-feira (15), pelo Minist\u00e9rio P\u00fablico, por corrup\u00e7\u00e3o passiva e lavagem de dinheiro na chamada ‘m\u00e1fia da merenda’.<\/p>\n

A den\u00fancia faz parte da opera\u00e7\u00e3o Alba Branca e \u00e9 do procurador-geral de Justi\u00e7a do Minist\u00e9rio P\u00fablico de S\u00e3o Paulo, Gianpaolo Smanio. Al\u00e9m de Fernando Capez, outras oito pessoas foram denunciadas.<\/p>\n

A opera\u00e7\u00e3o, que apura desvios no fornecimento da merenda escolar, foi deflagrada em janeiro de 2016.<\/p>\n

Os demais denunciados s\u00e3o dois ex-assessores do gabinete do deputado, dois integrantes da Secretaria da Educa\u00e7\u00e3o e quatro pessoas ligadas \u00e0 Coaf (Cooperativa Org\u00e2nica Agr\u00edcola Familiar) com sede em Bebedouro, no interior de S\u00e3o Paulo. Entre os denunciados est\u00e1 ainda o lobista Marcel Ferreira Julio, que fechou acordo de dela\u00e7\u00e3o premiada.<\/p>\n

Em nota, a assessoria de Capez informa que ele “esperava o momento correto e agora ter\u00e1 a oportunidade de demonstrar toda a verdade sobre os fatos. Al\u00e9m das in\u00fameras provas, o cunho pol\u00edtico eleitoral ficar\u00e1 ainda mais demonstrado. A den\u00fancia pretende aplicar responsabilidade objetiva por atos supostamente praticados por terceiros”, disse.<\/p>\n

Por ele ter foro especial, a den\u00fancia em quest\u00e3o ser\u00e1 analisada pelo \u00f3rg\u00e3o Especial do Tribunal de Justi\u00e7a. Ap\u00f3s esse processo, se a den\u00fancia for acolhida pelos 25 desembargadores do \u00f3rg\u00e3o, o deputado tucano se tornar\u00e1 r\u00e9u.<\/p>\n

De acordo com as investiga\u00e7\u00f5es, o dinheiro desviado do estado foi de R$ 1,11 milh\u00e3o, o equivalente a 10% dos contratos. Esse montante teria sido destinado ao pagamento das despesas de campanha do deputado em 2014.<\/p>\n

Suspens\u00e3o do mandato e bloqueio de bens<\/em><\/strong><\/p>\n

Em sua den\u00fancia, o procurador-geral de Justi\u00e7a pediu a suspens\u00e3o imediata do mandato de Capez e suas fun\u00e7\u00f5es como procurador de Justi\u00e7a. O Minist\u00e9rio P\u00fablico tamb\u00e9m pediu o bloqueio de bens no valor de R$ 2,27 milh\u00f5es como repara\u00e7\u00e3o.<\/p>\n

\u201cN\u00e3o bastasse o risco \u00e0 ordem p\u00fablica gerado pelas condutas do denunciado Fernando Capez, n\u00e3o se pode olvidar que os poderes inerentes aos cargos ocupados podem ser indevidamente utilizados por ele para constranger testemunhas e conturbar a colheita da prova\u201d, escreveu Gianpaolo na sua decis\u00e3o.<\/p>\n
