A decis\u00e3o se deu no \u00e2mbito de a\u00e7\u00e3o proposta pela Procuradoria-Geral da Rep\u00fablica (PGR) contra as novas regras definidas por Temer, que reduziu as exig\u00eancias para condenados obterem perd\u00e3o judicial.<\/p>\n<p>Em sua decis\u00e3o, C\u00e1rmen L\u00facia determinou a suspens\u00e3o dos trechos que versavam sobre o tempo m\u00ednimo de pris\u00e3o que o condenado deveria ter cumprido para conseguir o indulto natalino. O decreto de Temer exigia o cumprimento de ao menos um quinto da pena (para n\u00e3o reincidentes) e de um ter\u00e7o da pena (para reincidentes), independentemente do tempo de condena\u00e7\u00e3o. O indulto s\u00f3 seria concedido a condenados por crimes cometidos sem o emprego de viol\u00eancia &#8211; como em casos de corrup\u00e7\u00e3o e lavagem de dinheiro.<\/p>\n<p>A presidente do Supremo tamb\u00e9m anulou provisoriamente os efeitos dos trechos do decreto presidencial que versam sobre a situa\u00e7\u00e3o do condenado que poder\u00e1 receber o indulto e os efeitos da medida sobre o pagamento de multas impostas aos condenados.<\/p>\n<p>A suspens\u00e3o do decreto, publicado na semana passada ap\u00f3s assinatura de Temer, prevalecer\u00e1 at\u00e9 an\u00e1lise do relator da a\u00e7\u00e3o da PGR, ministro Lu\u00eds Roberto Barroso, ou pelo pr\u00f3prio plen\u00e1rio do STF, conforme decidiu C\u00e1rmen L\u00facia.<\/p>\n<p style=\"text-align: center\"><strong><em>Argumentos pr\u00f3 e contra o novo indulto de Natal<\/em><\/strong><\/p>\n<p>Ainda nesta quinta-feira, o ministro da Justi\u00e7a, Torquato Jardim, afirmou em artigo publicado no jornal O Globo que o indulto representa um &#8220;ato de clem\u00eancia&#8221; do presidente e defendeu que o indulto est\u00e1 previsto na Constitui\u00e7\u00e3o e &#8220;n\u00e3o depende de vontade judicial nem de alvitre do Minist\u00e9rio P\u00fablico&#8221;.<\/p>\n<p>Jardim havia reconhecido no \u00faltimo s\u00e1bado (23) que o relaxamento dos crit\u00e9rios representa um &#8220;ato humanit\u00e1rio&#8221; e reflete uma vis\u00e3o &#8220;liberal&#8221; do presidente. &#8220;O presidente Michel Temer \u00e9 professor de Direito Constitucional e conhece esse assunto como ningu\u00e9m. Ele entendeu&#8230; Como uma posi\u00e7\u00e3o pol\u00edtica que reflete vis\u00e3o mais liberal do direito penal, sem d\u00favida alguma&#8230; Que manter o apenado em regime fechado n\u00e3o \u00e9 necessariamente a melhor solu\u00e7\u00e3o.
