Advogados criminalistas de todo o Brasil articulam um movimento para pedir puni\u00e7\u00f5es no Conselho Nacional de Justi\u00e7a (CNJ) ao juiz federal S\u00e9rgio Moro, da 13\u00aa Vara Federal de Curitiba, relator dos processos relativos \u00e0s investiga\u00e7\u00f5es da Opera\u00e7\u00e3o Lava-Jato da Pol\u00edcia Federal. Os criminalistas dizem que h\u00e1 um vazamento seletivo do processo de investiga\u00e7\u00e3o em curso na Justi\u00e7a Federal. A Justi\u00e7a Federal do Paran\u00e1, policiais federais respons\u00e1veis pela Lava-Jato e procuradores envolvidos no caso negam qualquer tipo de manipula\u00e7\u00e3o.<\/p>\n

\"Ex-diretor<\/a><\/p>\n

Na semana passada, foram divulgados trechos do depoimento do ex-diretor de Refino e Abastecimento da Petrobras Paulo Roberto Costa, no qual ele afirmava que partidos como PP, PMDB e PT recebiam propina de contratos feitos pela petrol\u00edfera. Os partidos recebiam 3% de todos os contratos da Petrobras, segundo o depoimento de Costa \u00e0 Justi\u00e7a Federal. A presidente Dilma Rousseff (PT) classificou como \u201cmuito estranho e muito estarrecedor\u201d o epis\u00f3dio da divulga\u00e7\u00e3o do conte\u00fado desses depoimentos.<\/p>\n

O iG apurou que advogados criminalistas de todo o Brasil v\u00e3o entregar um abaixo-assinado ao presidente da Ordem dos Advogados do Brasil (OAB), Marcus Vin\u00edcius Coelho, pedindo para que a entidade se manifeste contra os vazamentos. Os advogados tamb\u00e9m querem que a ordem ingresse com uma representa\u00e7\u00e3o contra Moro no CNJ alegando \u201cparcialidade\u201d na condu\u00e7\u00e3o do processo e cerceamento do direito de defesa de pessoas que foram citadas no processo mas at\u00e9 agora n\u00e3o foram ouvidas pelo magistrado.<\/p>\n

Ainda conforme o iG apurou, o presidente da OAB j\u00e1 tem conhecimento desse movimento e deve levar o caso \u00e0 Comiss\u00e3o Especial de Garantia do Direito de Defesa da OAB presidida pelo advogado Fernando Santana. Al\u00e9m disso, o pleno da OAB tamb\u00e9m deve ser acionado para discutir diretamente a mat\u00e9ria.<\/p>\n

Na vis\u00e3o dos advogados criminalistas que articulam esse movimento contra Moro, houve irregularidades no vazamento de apenas parte das informa\u00e7\u00f5es, principalmente pelo fato de que pessoas citadas como o tesoureiro nacional do PT, Jo\u00e3o Vaccari Neto, n\u00e3o foram ouvidas para se defender das den\u00fancias feitas por Paulo Roberto Costa. Outro ponto destacado por advogados \u00e9 que n\u00e3o foi permitido a algumas assessorias jur\u00eddicas, como da pr\u00f3pria presidente Dilma Rousseff e do PT, acesso \u00e0 investiga\u00e7\u00e3o.<\/p>\n

O pr\u00f3prio PT vai ingressar em outra frente para a obten\u00e7\u00e3o da \u00edntegra dos depoimentos de Paulo Roberto Costa e do doleiro Alberto Youssef, acusado de comandar um esquema de lavagem de dinheiro que teria movimentado R$ 10 milh\u00f5es, no Supremo Tribunal Federal (STF). O PT alegar\u00e1 que precisar\u00e1 se defender de eventuais imputa\u00e7\u00f5es feitas por Costa ou mesmo por Youssef.<\/p>\n

Do outro lado, tanto a Justi\u00e7a Federal, quanto os procuradores respons\u00e1veis pelo caso e policiais federais, negam que exista qualquer tipo de irregularidade. Segundo os respons\u00e1veis pela investiga\u00e7\u00e3o, tem ocorrido uma esp\u00e9cie de \u201cconfus\u00e3o jur\u00eddica\u201d e at\u00e9 \u201cm\u00e1 f\u00e9 de interpreta\u00e7\u00e3o\u201d do processo de investiga\u00e7\u00e3o.<\/p>\n

Isso porque, os trechos do depoimento de Paulo Roberto Costa e do doleiro Alberto Youssef divulgados na semana passada n\u00e3o estavam em segredo de Justi\u00e7a. Eles explicam que existem 10 a\u00e7\u00f5es penais relacionadas \u00e0 Opera\u00e7\u00e3o Lava Jato e nem todas est\u00e3o sob sigilo.<\/p>\n

Apesar das rela\u00e7\u00f5es pr\u00f3ximas, os trechos que est\u00e3o sob sigilo s\u00e3o aqueles em que h\u00e1 participa\u00e7\u00e3o de parlamentares ou membros do governo. Al\u00e9m disso, o depoimento de Paulo Roberto Costa dado na semana passada, conforme os investiga\u00e7\u00f5es, est\u00e1 na fase de instru\u00e7\u00e3o processual e as audi\u00eancias puderam ser acompanhadas publicamente, conforme os investigadores.<\/p>\n

Nos bastidores, procuradores, policiais e delegados tem condenado a postura da presidente Dilma Rousseff de questionar as a\u00e7\u00f5es da Lava Jato. Eles alegam que esse tipo de postura presidencial fragiliza a obten\u00e7\u00e3o das provas e pode levar \u00e0 anula\u00e7\u00e3o de parte das investiga\u00e7\u00f5es. Essa, inclusive, \u00e9 a maior preocupa\u00e7\u00e3o do juiz S\u00e9rgio Moro. Exatamente por conta desse detalhe que Moro tem evitado, at\u00e9 mesmo, falar sobre a investiga\u00e7\u00e3o nessa fase de instru\u00e7\u00e3o.<\/p>\n
