Integrantes do Minist\u00e9rio P\u00fablico Federal ouvidos reservadamente pela reportagem usam a express\u00e3o \u201cgolpe institucional\u201d para classificar a resist\u00eancia do Senado &#8211; capitaneada por Renan &#8211; em cumprir uma decis\u00e3o da Suprema Corte.<\/p>\n<p>Neste caso, o crime de desobedi\u00eancia n\u00e3o teria sido cometido s\u00f3 por Renan, mas por toda a Mesa Diretora que assinou nesta tarde o comunicado no qual se recusa a cumprir a decis\u00e3o do STF.<\/p>\n<p>A avalia\u00e7\u00e3o nos bastidores da Procuradoria-Geral da Rep\u00fablica \u00e9 de qualquer decis\u00e3o judicial precisa ser cumprida, independentemente de ser monocr\u00e1tica. A Mesa do Senado informou que iria aguardar o julgamento do caso pelo plen\u00e1rio do STF, previsto para ocorrer na quarta-feira, 7.<\/p>\n<p>\u201cO Supremo tem de fazer valer sua decis\u00e3o\u201d, avalia um procurador. O crime de desobedi\u00eancia n\u00e3o gera, necessariamente, pris\u00e3o. Isso porque aqueles que desobedeceram a ordem legal podem, oficiados sobre o suposto crime, se comprometer ao comparecimento em juizado criminal para prestar esclarecimentos.<\/p>\n<p>Desde a segunda-feira, 5, o oficial de justi\u00e7a respons\u00e1vel por intimar Renan sobre a decis\u00e3o de Marco Aur\u00e9lio n\u00e3o conseguiu fazer com que o senador assinasse a notifica\u00e7\u00e3o. Mesmo assim, o peemedebista pode ser considerado \u201ccientificado\u201d se o oficial considerar que a inten\u00e7\u00e3o do senador foi evitar o cumprimento da decis\u00e3o do STF. O ministro Marco Aur\u00e9lio Mello tamb\u00e9m pode fazer uma requisi\u00e7\u00e3o de investiga\u00e7\u00e3o por crime de obedi\u00eancia. Ap\u00f3s a sess\u00e3o da 1\u00aa Turma do STF, o ministro permanece em seu gabinete.<\/p>\n<p>O procurador-geral da Rep\u00fablica, Rodrigo Janot, n\u00e3o participa, at\u00e9 o momento, de avalia\u00e7\u00f5es sobre o caso Renan.
