Para entender melhor o que diz a lei nesses casos, o\u00a0InfoMoney\u00a0foi ouvir especialistas jur\u00eddicos.<\/p>\n<p style=\"text-align: center\"><strong><em>Entenda o caso<\/em><\/strong><\/p>\n<p>Em maio de 2023, Ornaldo conduzia seu Renault Sandero branco 2018 pela Avenida Salim Farah Maluf, na Zona Leste de S\u00e3o Paulo, quando foi atingido por um Porsche avaliado em R$ 1,3 milh\u00e3o, dirigido pelo empres\u00e1rio Fernando Sastre de Andrade Filho, de 24 anos. Segundo laudo pericial, o Porsche trafegava a 136 quil\u00f4metros por hora, em via cujo limite \u00e9 de 50 quil\u00f4metros. Testemunhas relataram que o motorista do carro de luxo havia consumido bebida alco\u00f3lica antes da colis\u00e3o.<\/p>\n<p>A quest\u00e3o central \u00e9 que Ornaldo comprara, dois anos antes da trag\u00e9dia, seu Sandero por meio de um financiamento banc\u00e1rio de R$ 37 mil, com entrada de R$ 6,1 mil e saldo dividido em 48 parcelas de R$ 1,2 mil. Ele utilizava o carro para sustentar a fam\u00edlia e quitar o empr\u00e9stimo. Com a morte, restavam ainda 18 parcelas a vencer.<\/p>\n<p>Desde ent\u00e3o, a fam\u00edlia relatou ao jornal O Globo que vem recebendo liga\u00e7\u00f5es di\u00e1rias de advogados da financiadora Aymor\u00e9 cobrando a d\u00edvida, mesmo ap\u00f3s informar o falecimento<strong><em>. \u201cEles ligam para o meu celular mais de 10 vezes ao dia perguntando pelo meu marido. Isso \u00e9 muito dolorido, pois j\u00e1 foram avisados que ele morreu de forma tr\u00e1gica\u201d<\/em><\/strong>, disse Francilene Morais de Caldas, ao jornal. Ela afirma ter pedido que o banco recolha o carro, que permanece amassado em um estacionamento, como forma de encerrar o caso e evitar as lembran\u00e7as do acidente.<\/p>\n<p>O advogado da fam\u00edlia de Ornaldo, Jair Sotero da Silva, argumenta que o banco n\u00e3o poderia transferir a d\u00edvida para a vi\u00fava ou os filhos, mas sim habilitar-se no invent\u00e1rio como credor. Ele tamb\u00e9m critica a aus\u00eancia de seguro no contrato, o que considera uma falha, j\u00e1 que o ve\u00edculo estava alienado ao banco.<\/p>\n<p>No processo, a financiadora Aymor\u00e9 alega que a inadimpl\u00eancia come\u00e7ou em abril de 2024 e que, segundo entendimento recente do Superior Tribunal de Justi\u00e7a (STJ), basta o envio de notifica\u00e7\u00e3o extrajudicial para comprovar a mora, independentemente de quem a receba. O pedido judicial inclui a apreens\u00e3o do carro em at\u00e9 48 horas, com autoriza\u00e7\u00e3o para arrombamento e uso de for\u00e7a policial, se necess\u00e1rio, e a transfer\u00eancia da propriedade ao banco caso a d\u00edvida n\u00e3o seja paga em cinco dias ap\u00f3s a apreens\u00e3o.<\/p>\n<p style=\"text-align: center\"><strong><em>O que diz a lei<\/em><\/strong><\/p>\n<p>Segundo Wellington Viana Martins, advogado da Onda Segura, a quita\u00e7\u00e3o da d\u00edvida poderia ser resolvida de forma menos traum\u00e1tica caso houvesse seguro prestamista no contrato. <strong><em>\u201cSe o contrato previa essa cl\u00e1usula, a financiadora deveria acionar a seguradora. A fam\u00edlia deve comunicar o \u00f3bito, abrir o sinistro e, assim, o seguro quita ou amortiza as parcelas restantes. Mas nem todos os financiamentos incluem esse seguro, pois n\u00e3o \u00e9 obrigat\u00f3rio\u201d<\/em><\/strong>, explica.<\/p>\n<p>J\u00e1 o advogado Henrique Covolam, do escrit\u00f3rio Bruno Boris Advogados, destaca que <strong><em>\u201cd\u00edvidas n\u00e3o s\u00e3o herdadas\u201d<\/em><\/strong>, mas os direitos sobre bens financiados entram no invent\u00e1rio. <strong><em>\u201cA fam\u00edlia pode decidir se assume o financiamento para ficar com o bem ou se vende, quitando o saldo devedor.
